  1. Breathalyzers can be inaccurate. The machines may not always be properly installed, maintained, and calibrated. In fact, medical issues, diets, and medications can lead to false results.
  2. Field sobriety tests can also be inaccurate. The tests are usually subjective and can be extremely difficult to administer correctly, especially along the side of the road. Medical conditions and medications can affect your performance on these as well.
  3. A DUI is the only offense where a state can try you twice. They can try you criminally and also try a civil suit to suspend your license. You only have 10 days from the date of arrest to request a hearing or your license is automatically suspended.
